Filing 6 MERIT REVIEW ORDER entered by Judge Colin Stirling Bruce on 8/30/2022. Plaintiff's motion for leave to file an exhibit to his Complaint #5 is GRANTED. Pursuant to its merit review of the Complaint under 28 U.S.C. Sec 1915A, the Court finds that Plaintiff's Complaint states two claims: (1) a claim under the Eighth Amendment and (2) a claim under the Fourteenth Amendment's Equal Protection Clause. Murphy v. Raoul, 380 F. Supp. 3d 731 (N.D. Ill. 2019); Stone v. Jeffreys, 2022 WL 1292220, * 1 (N.D. Ill. Apr. 29, 2022). Plaintiff may proceed on these claims against Defendants Raoul, Jeffreys, and Greene. Any additional claim(s) shall not be included in the case, except at the Court's discretion on motion by a party for good cause shown or pursuant to Federal Rule of Civil Procedure 15. Plaintiff's Complaint does not state a claim upon which relief can be granted against the Parole Review Board, and therefore, the Clerk of the Court is directed to dismiss the Parole Review Board as a party Defendant. Fed. R. Civ. Pro. 12(b)(6); 28 U.S.C. Sec 1915A. The Clerk is directed to enter the standard qualified protective order pursuant to the Health Insurance Portability and Accountability Act. The Clerk is further directed to attempt service of process upon Defendants Raoul, Jeffreys, and Green pursuant to the Court's standard procedures. See written order. (KE) |
NOTICE: The Clerk of the Court has been informed by Notice of Change of Address recently filed by Plaintiff in cause numbers 21-3163, 21-3155, 21-3166, and 21-3164 that effective immediately, Plaintiff is now located at 215 E. New York, Aurora, IL 60505. It has been noted by the Clerks Office that this case is also pending in the Central District of Illinois, but Plaintiff has not filed a Notice of Change of Address in this case. Plaintiff is reminded that he is under a continuing obligation to keep the Clerk and each opposing party informed of any change in his location. Pursuant to Central District of Illinois Local Rule 16.3(K), every pro se plaintiff must notify the Clerk of this court in writing of any change of address during the entire pendency of his case. TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis entered by Judge Colin Stirling Bruce on 7/26/2022. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $2.37. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff`s account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full.
