November 2, 2022 Opinion or Order Filing 10 MERIT REVIEW ORDER Entered by Chief Judge Sara Darrow on 11/2/2022. IT IS THEREFORE ORDERED: 1. Pursuant to its merit review of the Complaint under 28 U.S.C. 1915A, the court finds that the plaintiff states a Fourteenth Amendment claim for failure to provide adequate medical care against Defendants Burkhead and Reynolds. Any additional claims shall not be included in the case, except at the courts discretion on motion by a party for good cause shown or pursuant to Federal Rule of Civil Procedure 15. 2. This case is now in the process of service. 3. The plaintiff shall immediately notify the court, in writing, of any change in his mailing address and telephone number. The plaintiff's failure to notify the court of a change in mailing address or phone number will result in dismissal of this lawsuit, with prejudice. 4. The clerk is directed to enter the standard qualified protective order pursuant to the Health Insurance Portability and Accountability Act. 5. The clerk is directed to terminate Defendants Durant, Chamberlin, Miller, Reedy, Williams, Atteberry, Gritzmacher, and Michael B. as defendants. 6. The clerk is directed to attempt service on Defendants Burkhead and Reynolds pursuant to the standard procedures. 7. Plaintiff's motion for counsel #4 is denied, with leave to renew upon demonstrating that he made attempts to hire his own counsel. Pruitt v. Mote, 503 F.3d 647, 654-55 (7th Cir. 2007). This typically requires writing to several lawyers and attaching the responses. If Plaintiff renews his motion, he should set forth how far he has gone in school, any jobs he has held inside and outside of prison, any classes he has taken in prison, and any prior litigation experience he has. October 3, 2022 Opinion or Order TEXT ORDER entered by Chief Judge Sara Darrow on 10/3/2022. The Clerk of the Court has been informed by Shelby County Jail that Plaintiff is no longer at their facility and is in IDOC custody. Plaintiff is reminded that he is under a continuing obligation to keep the Clerk and each opposing party informed of any change in his location. Pursuant to Central District of Illinois Local Rule 16.3(K), every pro se plaintiff must notify the Clerk of this court in writing of any change of address during the entire pendency of his case. It is not the Court's responsibility to independently maintain current addresses on all parties to pending actions. As a courtesy to Plaintiff, however, the Clerk is DIRECTED to send a copy of this Notice to Plaintiff at the institution where he has reportedly been transferred. Plaintiff shall, no later than 14 days from the date of this Notice, file a notice of change of address with the Clerk. Failure to do so will result in dismissal of this action. September 22, 2022 Opinion or Order TEXT ORDER entered by Chief Judge Sara Darrow on 9/22/2022 granting #3 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $47.23. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff`s account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full.
