TEXT ORDER by US Magistrate Judge Karen McNaught: Defense counsel contacted chambers to ask whether his motion to compel arbitration, which requests dismissal of this action, stays the time for an answer. Rule 12(a)(1) of the Federal Rules of Civil Procedure specifies the time for filing a responsive pleading. Rule 12(a)(4) provides unless the Court orders otherwise, a motion under Rule 12 alters the deadline. Defendants have cited a 10th Circuit decision as finding a motion to dismiss and compel arbitration to count as a responsive pleading under Rule 12. Plaintiff has not been given the opportunity for input. The Court will not provide an advisory opinion on the correctness of defendants' interpretation.(HS) |
