TEXT ORDER entered by Judge Colleen R. Lawless on 6/8/2023: Before the Court is Plaintiff's Motion for Temporary Restraining OrderPermanent Injunction and Demand for an Emergency Hearing #5 . Specifically, Plaintiff asks this court to restrain the defendants from any further state court action until the federal court dispute is adjudicated. The Younger abstention doctrine prohibits federal courts from intervening in ongoing state proceedings. Younger v. Harris, 401 U.S. 37 (1971). The Younger abstention doctrine applies when the federal plaintiffs requested relief would interfere with an ongoing state criminal proceeding. See Mass. Delivery Assn v. Coakley, 671 F.3d 33, 40 (1st Cir. 2012). Here, Plaintiff's claims would certainly disrupt the pending state case as he is requesting this Court stop the state proceedings relating to his traffic violation. Plaintiff has not demonstrated any extraordinary circumstances that would make abstention inappropriate. Therefore, based on the Younger abstention doctrine, Plaintiffs Motion is DENIED. (BL) |
