TEXT ORDER entered by Judge Sue Myerscough on 11/27/2023: On October 27, 2023, Defendant Curry Chiropractic, P.A. filed a Motion to Dismiss for Lack of Jurisdiction (d/e #5 ), stating the Court lacks subject matter jurisdiction because "Curry Chiropractic, P.A." does not exist and has never existed.On November 9, 2023, Plaintiff filed an Amended Complaint (d/e #7 ), naming Dr. John C. Curry and Curry Chiropractic, PLLC as Defendants. Pursuant to Federal Rule of Civil Procedure 15(a)(1)(B), Plaintiff's Amended Complaint is timely as it was filed within 21 days of Defendant's 12(b)(1) Motion to Dismiss. Therefore, Plaintiff's Amended Complaint will remain docketed. Pursuant to Local Rule 7.1(E), Defendant's Motion to Dismiss (d/e #5 ) is DENIED as MOOT. Defendants are directed to respond on or before December 4, 2023, to Plaintiff's Amended Complaint. (HS)
