| TEXT ORDER entered by U.S. District Judge Sue E. Myerscough on 12/13/2023: Before the Court is a Motion to Dismiss for Failure to State a Claim and/or Insufficient Process filed by Defendants Granite City, Granite City Police Officer #1, and Granite City Police Officer #2. Defs.' Mot. to Dismiss, d/e #8 . Although all the papers filed in this matter indicate that they properly were served on counsel to Plaintiff Jerry Yeager, Jr., Mr. Yeager's counsel has yet to enter an appearance. Similarly, although Local Rule 7.1 requires any party opposing a motion to dismiss to respond within 14 days of service, LR-Civ. 7.1(B)(2), Mr. Yeager has yet to respond to the motion to dismiss. Mr. Yeager is DIRECTED to file, by December 21, 2023, an entry of appearance and a response to the motion to dismiss. Because nearly two months have passed since Defendants filed the operative motion, Mr. Yeager is advised that failing to comply with the Court's order may result in dismissal of this action for want of prosecution. See generally GCIU Emp. Ret. Fund v. Chicago Tribune Co., 8 F.3d 1195, 1199 (7th Cir. 1993) ("It is well-established that district courts possess inherent authority to dismiss a case sua sponte for a plaintiff's failure to prosecute.").(GL) |
