March 14, 2024 Opinion or Order TEXT ORDER granting #7 Petition to Proceed In Forma Pauperis entered by Judge Colin Stirling Bruce on 3/14/2024. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $20.30. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff`s account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full. The Clerk is directed to mail a copy of this order to Plaintiff`s place of confinement, to the attention of the Trust Fund Office, and to Plaintiff. Prisoner Prepayment due by 4/15/2024. (KE)

February 28, 2024 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 2/28/2024. Plaintiff's motion to request counsel #5 is DENIED. The Court generally will not consider recruiting counsel for a pro se plaintiff until the Court determines that he possess a claim upon which relief can be granted after the Court conducts a review of the complaint. Plaintiff may renew his motion if his claim survives that review that the Court will conduct in the near future. (KE)
February 28, 2024 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 2/28/2024. Plaintiff's motion for leave to proceed in forma pauperis #3 is DENIED with leave to re- file. Plaintiff has filed a motion asking for leave to proceed IFP in this case, but his motion is incomplete. Plaintiff has only submitted the first page of the Court's IFP form, and therefore, Plaintiff has not submitted all of the information that the Court needs to make a decision as to whether the Court should allow Plaintiff to proceed IFP in this case. Although he does not necessarily need to use the Court's form to move for leave to proceed in forma pauperis, Plaintiff must provide all of the information that the form requires in his IFP motion. Plaintiff has not done so, and therefore, his IFP motion is denied. If he desires to proceed IFP in this case, Plaintiff must renew his motion and must provide all of information necessary to make an IFP ruling to the Court by March 15, 2024. If Plaintiff does not timely renew his IFP motion or if he does not provide all of the necessary information, the Court will dismiss this case for failure to pay the required filing fee. Alternatively, Plaintiff may pay the $405.00 filing fee, in full, by March 15, 2024, if he desires to litigate this case. The Clerk of the Court is directed to send the forms necessary for Plaintiff to move for leave to proceed in forma pauperis in this case to the extent that he wants to use these forms and to the extent that he wants to seek IFP status.
