TEXT ORDER Entered by Judge Colin Stirling Bruce on 8/19/24. On July 23, 2024, Plaintiff filed this case, under 42 USC Section 1983, alleging a violation of his Constitutional rights. Along with his Complaint, Plaintiff filed a motion for leave to proceed in forma pauperis. On July 29, 2024, the Court conducted a merit review of Plaintiff's Complaint and also considered his IFP motion. In that Order, the Court noted that Plaintiff had accumulated three or more strikes under the Prison Litigation Reform Act. The Court also noted that Plaintiff had not alleged in his Complaint that he was under an imminent danger of a serious physical injury that would (possibly) allow him to proceed IFP despite his three-strikes status. Accordingly, the Court gave Plaintiff until August 16, 2024, within which to pay the required filing fee, in full. The Court informed Plaintiff that, if he did not timely pay the filing fee in full, the Court would dismiss this case. As of today, Plaintiff has failed to respond to the Courts July 29, 2024 Order. More specifically, Plaintiff has failed to pay the required filing fee. Accordingly, this case is DISMISSED WITHOUT PREJUDICE based upon Plaintiff's failure to comply with the Court's July 29, 2024 Order and based upon Plaintiffs failure to pay the required filing fee in full. This case is closed. No judgment to enter(ANW)

MERIT REVIEW ORDER entered by Judge Colin Stirling Bruce on 7/29/2024. IT IS, THEREFORE, ORDERED: 1. Plaintiff's motion to proceed in forma pauperis #3 is DENIED. 2. Plaintiff has up to and including August 16, 2024, within which to pay the required filing fee of $405.00, in full. 3. If Plaintiff fails to pay the filing fee, in fully, by August 16, 2024, the Court will dismiss this case based upon his failure to pay the filing fee and based upon his failure to comply with this Order.
