| Filing 12 MINUTE entry before the Honorable Thomas M. Durkin: The parties have filed an agreed motion to transfer this case to the Central District of Illinois, Springfield Division. When a case is brought in the wrong venue, transfer pursuant to 28 U.S.C. 1406 "is ordinarily in the interest of justice." Goldlawr Inc. v. Heiman, 369 U.S. 463 (1962). Here, all of the criteria for transfer to the Central District pursuant to 1406(a) are met: (1) Defendant has not challenged this Court's subject matter jurisdiction (i.e., federal-question jurisdiction pursuant to 28 U.S.C. 1331); (2) venue is proper in the Central District because Defendant is located in the Central District and the acts giving rise to Plaintiff's claim occurred in the Central District; and (3) judicial economy favors transfer to the proper venue rather than requiring filing of an entirely new complaint raising identical claims in the Central District. For those reasons, the Court grants the agreed motion #11 and transfers this action forthwith to the Central District of Illinois, Springfield Division. Mailed notice. (ecw, ) |
