TEXT ORDER entered by Magistrate Judge Douglas J. Quivey on 8/26/25: Before the Court is Defendants' Motion for Leave to File a Reply Brief, (Doc. 75), and Plaintiff's Motion for Issuance of Subpoenas (Doc. 68). Defendants seek leave to file a Reply Brief that was supposed to be attached as an Exhibit. Instead, the Reply was filed as a separate document (Doc. 74). Regardless, the Motion for Leave to file a Reply is GRANTED and (Doc. 74) shall remain filed as the Reply. In regard to Plaintiff's Motion for Issuance of Subpoenas, for the reasons stated in Defendants Response, (Doc. 76), the MOTION (Doc. 68) is DENIED at this time. Plaintiff is granted leave to file a similar motion as it relates to subpoenas to non-named parties after the motion to dismiss is adjudicated and a Rule 16 scheduling order is entered.(AWR)

TEXT ORDER entered by Magistrate Judge Douglas J. Quivey on 8/5/25: Before the Court is Plaintiff's Renewed Motion for Appointment of Counsel. (Doc. 64). Plaintiff presents only one new argument that was not present in his prior motions. He now argues that an injury suffered while employed by one of the Defendants, different than the "serious medical condition" mentioned in his prior motion, "significantly impairs his ability to continue pro se litigation." (Doc. 64, p. 1-2). However, despite these medical infirmities, Plaintiff has shown that he can adequately communicate his positions to the Court as this point in the litigation. Therefore, for this reason and those stated in the prior Orders, (Doc. 60, Text Order 7/31/2025, Text Order 8/1/2025), Plaintiff's Motion is DENIED. Further, although Jones requests a hearing on his Motion, (Doc. 64, p. 2), the Court finds that a hearing is not necessary.(AWR)

TEXT ORDER entered by Magistrate Judge Douglas J. Quivey on 8/1/2025: Before the Court is Plaintiff's Motion for Reconsideration of Denial of Appointment of Counsel. #63 . Plaintiff presents only one new argument that was not present in his prior motions. He argues that since 2021 he has a "serious medical condition" that "significantly impairs his ability to litigate without legal assistance." However, this condition predates his claims, during which time he was employed full time by one or more of the Defendants. Therefore, for this reason and those stated in the prior Orders, ( #60 and Text Order 7/31/2025), Plaintiff's Motion is DENIED. Further, although Jones requests a hearing on his Motion, ( #63 , p. 2), the Court finds that a hearing is not necessary. (JA)

TEXT ORDER entered by Magistrate Judge Douglas J. Quivey on 7/31/2025: Before the Court is Plaintiff's Renewed Motion for Appointment of Counsel. #62 . On July 23, 2025, the Court previously denied Plaintiff's second Motion to Request Counsel that was filed in the Central District of Illinois. #57 . Plaintiff presents only one new argument that was not present in his second motion. He argues that because the Court denied his request for relief from paying discovery costs, he cannot "effectively pursue discovery without assistance of counsel." #62 , p. 1). "However, the Court will not recruit counsel simply to absorb Plaintiff's costs." Gregory v. Jeffreys, 2022 WL 617408, at 8 (C.D.Ill. Mar. 2, 2022). Therefore, for this reason and those stated in the prior Order, #60 , Plaintiff's Motion is DENIED. (JA)

TEXT ORDER entered by Magistrate Judge Douglas J. Quivey on 7/30/25: Before the Court is Plaintiff's Motion to be Excused from Paying Discovery Costs and Motion for Leave to Participate in Electronic Case Filing (CM/ECF). (Doc. 61). Although Plaintiff's motion to proceed in forma pauperis was granted, the Court is not authorized by 28 U.S.C. 1915 to fund his discovery. See Smith v. Campagna, 1996 WL 364770 at 1 (N.D.Ill. June 26, 1996); see also McNeil v. Lowery, 831 F.2d. 1368, 1372 (7th Cir. 1987) ("A litigant's constitutional right of access to the courts does not include a waiver of witness fees so that an indigent plaintiff can present his case fully to the court."); Lindell v. McCallum, 352 F.3d 1107, 1111 (7th Cir. 2003) (a pro se plaintiff proceeding in forma pauperis "has no constitutional entitlement to subsidy...to prosecute a civil suit; like any other civil litigant, he must decide which of his legal actions is important enough to fund" (internal citations omitted)). Therefore, Plaintiff's request for relief from paying discovery costs is DENIED. However, Plaintiff's request to access CM/ECF is GRANTED. Plaintiff is directed to register for electronic filing by 1) obtaining a Pacer Account at www.pacer.gov and then 2) requesting filer permission by following the instructions found at Registering for an E-Filing Account at the bottom of the Courts web page at https://www.ilcd.uscourts.gov/content/attorney-admission-pacer. Lawless on 6/20/2025: Before the Court is Plaintiff Don Jones's Amended Motion to Allow Plaintiff Additional Time for Responding to Defendant's Answer of Complaint to Allow the Court to Rule on Court on Plaintiff's Motion Requesting Counsel #50 . To the extent that Plaintiff requests an extension of time to respond to Defendants' Motion to Dismiss, Plaintiff's motion is GRANTED. In light of Plaintiff's pro se status, the deadline to respond is extended to 7/18/2025. Plaintiff has not shown he is entitled to the appointment of counsel. Before granting an indigent plaintiff's request for counsel, district courts must first consider whether the plaintiff made a reasonable attempt to obtain counsel. Olson v. Morgan, 750 F.3d 708, 711 (7th Cir. 2014). Plaintiffs initial motion was denied by U.S. Magistrate Judge Eric Long because Plaintiff failed to show he had attempted to retain counsel by writing to several lawyers and attaching the responses. (Text Order of 5/2/2025). Plaintiff has only shown that he contacted one law firm in seeking to obtain counsel. The Court concludes that Plaintiff's submission of one letter from an attorney declining to assist him does not establish a reasonable attempt to obtain counsel. See Olson, 750 F.3d at 711 (finding that plaintiff satisfied the first element by submitting letters from several attorneys declining to assist him). Plaintiff's Motion #50 is DENIED to the extent that he asks the Court to appoint him counsel. Defendants' Motion for Leave to File a Response to Plaintiff's Amended Request for Appointment of Counsel #51 is GRANTED. Defendants' Response #52 has been filed. (AWR)

| Filing 8 MINUTE entry before the Honorable LaShonda A. Hunt: Plaintiff's application for leave to proceed in forma pauperis #4 is denied without prejudice. Plaintiff's application states that his average monthly income over the past 12 months from employment was "$0.00," but Plaintiff also reports that he was employed at some point in 2024. Both cannot be true. Further, Plaintiff's application lists his gross monthly pay from his employment from 2018 to 2023 as "$3.04" and from 2023 to 2024 as "3.20," which raises questions about how he supported himself during that time. "To qualify for [in forma pauperis] status, a plaintiff must fully disclose [his] financial condition, and [he] must do so truthfully under penalty of perjury." Effinger v. Monterrey Sec. Consultants, 546 F. Supp. 3d 715, 717 (N.D. Ill. 2021). By 1/21/25, Plaintiff must file a revised application for leave to proceed in forma pauperis which accurately details his finances or pay the required filing fee. Failure to file an accurate application may result in dismissal of this case without prejudice as a sanction. Plaintiff's motion for attorney representation #5 is denied without prejudice, as Plaintiff has failed to demonstrate any effort to contact attorneys to represent him pro bono beyond the EEOC. TEXT ORDER entered by Magistrate Judge Douglas J. Quivey on 8/26/25: Before the Court is Defendants' Motion for Leave to File a Reply Brief, (Doc. 75), and Plaintiff's Motion for Issuance of Subpoenas (Doc. 68). Defendants seek leave to file a Reply Brief that was supposed to be attached as an Exhibit. Instead, the Reply was filed as a separate document (Doc. 74). Regardless, the Motion for Leave to file a Reply is GRANTED and (Doc. 74) shall remain filed as the Reply. In regard to Plaintiff's Motion for Issuance of Subpoenas, for the reasons stated in Defendants Response, (Doc. 76), the MOTION (Doc. 68) is DENIED at this time. Plaintiff is granted leave to file a similar motion as it relates to subpoenas to non-named parties after the motion to dismiss is adjudicated and a Rule 16 scheduling order is entered.(AWR)
