MERIT REVIEW ORDER entered by Judge Michael M. Mihm on 6/2/2025. IT IS THEREFORE ORDERED: According to the Court's merit review of Plaintiff's Complaint under 28 U.S.C. 1915A, this case shall proceed on (1) an Eighth Amendment failure-to-protect claim against Defendants Fugua, Rupkin, and Formen, and (2) an Eighth Amendment claim against Defendant Littles (Mental Health Counselor) based on her alleged deliberate indifference to Plaintiff's mental health needs. Additional claims shall not be included in the case above, except in the Court's discretion on motion by a party for good cause shown under Federal Rule of Civil Procedure 15. Defendants Littles (Internal Affairs Officer/Lieutenant), Bright, Brittany P. Greene, Western Illinois Staff, Ford, Radecki, and Miller are DISMISSED WITHOUT PREJUDICE for failure to state a claim pursuant to Federal Rule of Civil Procedure 12(b)(6) and 1915A. The Clerk is directed to TERMINATE these Defendants. Plaintiff is given leave to file an Amended Complaint within 30 days of this Order. Plaintiff's Amended Complaint will replace his Complaint in its entirety and must contain all allegations against all Defendants. Piecemeal amendments are not accepted. The Clerk is directed to enter the standard qualified protective order pursuant to the Health Insurance Portability and Accountability Act. The Clerk is directed to set an internal court deadline 60 days from the entry of this Order for the Court to check on the status of service and enter scheduling deadlines. See written Order.(JS)

TEXT ORDER granting #5 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $22.81. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. The Clerk is directed to mail a copy of this order to Plaintiff's place of confinement, to the attention of the Trust Fund Office, and to Plaintiff. Prisoner Prepayment due by 6/27/2025. TEXT ORDER entered by Judge Michael M. Mihm on 5/20/2025. On 4/22/2025, the Court ordered Plaintiff to pay the $405 filing fee or file a petition to proceed in forma pauperis by 5/13/2025. Plaintiff now files a Motion for Extension of Time to File Petition to Proceed in forma pauperis #4 requesting additional time to file his petition to proceed in forma pauperis because he is waiting for prison officials at Western Illinois Correctional Center to provide him with his trust fund ledgers. Plaintiff does not state how much additional time he needs. Under the circumstances, the Court finds that an additional 21 days is appropriate. Plaintiff's Motion #4 is GRANTED. Plaintiff must pay the $405 filing fee in full or file a petition to proceed in forma pauperis with attached trust fund ledgers for the last 6 months by 6/10/2025. Failure to do so will result in the dismissal of this case without prejudice. (VH)
