August 18, 2025 Opinion or Order Filing 11 ORDER entered by Judge Colin Stirling Bruce on 8/18/2025. Plaintiff's Complaint is DISMISSED WITHOUT PREJUDICE because it fails to state a claim upon which relief can be granted. 28 U.S.C. Sec 1915A; Fed. R. Civ. Pro. 12(b)(6). This case is closed, and all pending motions are denied as moot. The Clerk of the Court is directed to enter judgment in Defendants' favor and against Plaintiff pursuant to Federal Rule of Civil Procedure 58. The Clerk of the Court is also directed to add this dismissal to the Court's "three-strikes" list under the Prison Litigation Reform Act. Plaintiff is advised that this dismissal may count as a "strike" under 28 U.S.C. 1915(g). If a court determines in the future that he has accumulated three strikes, Plaintiff may be prohibited from proceeding in forma pauperis in future litigation. If he wishes to appeal this dismissal, Plaintiff must file a notice of appeal with this Court within thirty (30) days of the entry of judgment. Fed. R. App. P. 4(a). A motion for leave to appeal in forma pauperis should set forth the issues that Plaintiff plans to present on appeal. Fed. R. App. P. 24(a)(1)(C). If he chooses to appeal, Plaintiff will be liable for the $605.00 appellate filing fee regardless of the outcome of the appeal. See written order. (KE)
July 21, 2025 Opinion or Order Filing 10 MERIT REVIEW ORDER entered by Judge Colin Stirling Bruce on 7/21/2025. Based upon the merit review of Plaintiff's Complaint that is required by 28 U.S.C. 1915A, the Court finds that Plaintiff's Complaint fails to state a claim upon which relief can be granted. Plaintiff is given twenty-one (21) days from the date of this Order to file a proposed amended complaint that complies with the dictates of this Order. If Plaintiff fails to file a proposed amended complaint by this deadline, the Court will dismiss this case. See written order. (KE)

The Court generally will not consider recruiting counsel for a pro se plaintiff until the Court determines that he possess a claim upon which relief can be granted after the Court conducts a review of the complaint. Plaintiff may renew his motion if his claim survives that review that the Court will conduct in the near future. (KE)

The Court's May 22, 2025 Text Order regarding the payment of the filing fee or the filing of a motion to proceed in forma pauperis is STRICKEN as improvidently filed. Plaintiff paid the filing fee to the United States District Court for the Southern District of Illinois before that court transferred this case. Plaintiff need not pay another filing fee to this Court. Therefore, the Court's May 22, 2025 Text Order is stricken, and the Court will review Plaintiff's Complaint, as required by 28 U.S.C. Section 1915A, as soon as the Court's schedule permits. (KE)
May 23, 2025 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 5/23/2025. Plaintiff's motion to issue summons #4 is DENIED as premature. Because he was a prisoner for purposes of the Prison Litigation Reform Act during the relevant time, the Court must screen Plaintiff's Complaint to determine whether his Complaint states a claim upon which relief can be granted. See 28 USC Section 1915A. After the Court conducts a merit review of Plaintiff's Complaint and if the Court determines that his Complaint states a valid claim, the Court will consider Plaintiff's request to assist him with effecting service of process.
