ORDER entered by Judge Colin Stirling Bruce on 12/29/2025. IT IS, THEREFORE, ORDERED: 1. Plaintiff's second motion for leave to proceed in forma pauperis #10 is DENIED. 2. Accordingly, this case is DISMISSED WITHOUT PREJUDICE based upon Plaintiff's failure to pay the filing fee of $405.00, in full, and based upon Plaintiff's failure to comply with the Court's November 24, 2025 Order. 3. This case is now CLOSED; no Judgment to enter. 4. Plaintiff may move to re-open this case by January 5, 2026. 5. If he moves to re-open this case, Plaintiff must pay the $405.00 filing fee along with his motion. 6. If Plaintiff does not move to re- open this case by January 5, 2026, and if he does not accompany his motion with the payment of $405.00 for the filing fee, this case will remain closed. TEXT ORDER entered by Judge Colin Stirling Bruce on 10/7/2025. On July 11, 2025, Plaintiff filed this case alleging a violation of his Constitutional rights. However, Plaintiff did not pay the required $405.00 filing fee, nor did he move for leave to proceed in forma pauperis. Accordingly, the Court ordered Plaintiff to take one of these two actions by August 1, 2025. The Court warned Plaintiff that it may dismiss this case if he failed to comply with the Court's Order. On August 4, 2025, Plaintiff asked the Court to extend this deadline. Based upon his motion, the Court gave Plaintiff up to and including September 29, 2025, within which to pay the required filing fee or to move for leave to proceed IFP. On September 23, 2025, Plaintiff submitted his prison trust fund ledgers to the Court and asked the Court to grant his "motion." However, Plaintiff did not complete and file the Court's IPF form, nor did he file a separate motion that contains the information necessary for the Court to determine whether Plaintiff is eligible to proceed IFP in this case. Accordingly, the Court will give Plaintiff one last opportunity to comply before dismissing this case. The Clerk of the Court is directed to send the forms necessary for Plaintiff to move for leave to proceed in forma pauperis in this case. Plaintiff should complete these forms and file them with the Court after he has provided the required information and signed the forms so that the Court can determine if he is eligible for IFP status. If he does not want to use the Court's forms, Plaintiff should file a motion seeking leave to proceed in forma pauperis that provides all of the information required by the Court's IFP form. Plaintiff must move for IFP status or pay the $405.00 filing fee by October 31, 2025. Otherwise, the Court will dismiss this case. (KE) Modified on 10/8/2025 to correct typographical error. (KE).
