For the reasons stated, the Motion is GRANTED. Defendants have until October 1, 2025 to answer or otherwise respond to the Complaint. (RAH)

TEXT ORDER entered by Magistrate Judge Douglas J. Quivey on 8/28/2025: On 8/13/2025 the Clerk's Office returned the money order that Plaintiff sent with his complaint because it was in an amount greater than the $405.00 filing fee and informed Plaintiff that he needed to resubmit the filing fee in the exact amount. To date, the fee has not been paid. Within 14 days of the entry of this order, Plaintiff must pay the $405.00 filing fee. Failure to comply without good cause may result in dismissal without prejudice. Additionally, Plaintiff filed an Affidavit of Service for Complaint (Doc. #6 ) on 8/26/2025. However, because the filing fee has not been paid, the Clerk has yet to issue signed and sealed summonses. Therefore, once the filing fee is paid and the Clerk issues the summonses to Plaintiff, pursuant to Fed. R. Civ. P. 4, the Defendants will need to be served with the summons and complaint or execute waivers of service. (RAH)

TEXT ORDER entered by Magistrate Judge Douglas J. Quivey on 8/25/2025: Before the Court is Pro Se Plaintiff Chad Arnold's Motion for Extension of Time to File Answer (Doc. #4 ) and Ex Parte Motion. (Doc. #5 ). In the Motion for an Extension of Time, Plaintiff notes that he filed a Complaint and Motion for Preliminary Injunction on August 11, 2025, but that the Defendants have not yet been served. He also suggests response and reply deadlines for both the Defendants and Plaintiff for the Preliminary Injunction motion based upon when he expects Defendants will be served. Although the Court appreciates Plaintiff's recognition that the Defendants will need time to respond after service, the Court DENIES the motion. (Doc. #4 ). The Court will set a briefing schedule after Defendants are served and respond to the Motion for Preliminary Injunction. If undue delay occurs after Defendants are served and before they respond, the Court will set a status hearing. The Court also DENIES Plaintiff's Ex Parte Motion, (Doc. #5 ), in which he seeks to replace the proposed Order he filed with his Motion for Preliminary Injunction, (Doc. #2 ), with a new proposed Order. Although the Motion is DENIED, the Court will consider Attachment A to (Doc. #5 ) as the Proposed Order instead of the Proposed Order filed with the Motion for Preliminary Injunction (Doc. 2-3). The Clerk is also ordered to unseal (Doc. #5 ). (RAH)
