Quivey on 10/20/2025: Before the Court is Plaintiff Maxwell's Motion for Voluntarily Dismissal of Co-Plaintiff Poindexter without prejudice pursuant to Fed. R. Civ. P. 41(a)(2). (Doc. #12 ). The Federal Rules of Civil Procedure, including Rule 41(a)(2), do not allow for one plaintiff to dismiss the cause of action of another plaintiff. Thus, the Motion, (Doc. #12 ), is DENIED. If Plaintiff Poindexter wants to dismiss her case against Defendants, she must file a motion she signs. Fed. R. Civ. P. 11. (BL)

TEXT ORDER entered by Magistrate Judge Douglas J. Quivey on 9/22/25: Before the Court is Plaintiffs' Motion for Sanctions and Motion to Amend Complaint. (Doc. #11 ). Plaintiffs seek sanctions against Defendants Parker, Adams, Mattson, and Affrunti arising from a wardship petition in 25-JA-5 (Montgomery Co.). Plaintiffs, however, have not yet served any of the Defendants and any of the complained about conduct occurred before this Court had jurisdiction over them. Moreover, the Court has invoked the Younger abstention doctrine and this Court is not going to interfere with any of the state court proceedings to include 25-JA-5. (9-2-25 Order). Thus, the Motion as it relates to sanctions, is DENIED. The Motion as it relates to seeking leave to file an amended complaint is DENIED at this time with leave to refile, if needed, after Plaintiffs serve all of the Defendants with the existing Complaint and all of the Defendants answer or otherwise respond. Plaintiffs are also reminded that they should not combine multiple motions in one motion. (BL) Modified on 9/22/2025 to correct a clerical error. (BL)
