TEXT ORDER entered by Magistrate Judge Douglas J. Quivey on 11/24/2025: Before the Court is Plaintiff's Motion for Leave to File Supplemental Document in Support of her Amended Motion to Proceed In Forma Pauperis. (Doc. #6 ). Plaintiff's Motion is DENIED as moot. Judgment was entered on November 7, 2025. As indicated in the Court's November 12, 2025 Order, if Plaintiff wants to continue pursuing her claim, she needs to file a new complaint starting a new case. If she files a new case and seeks to proceed in forma pauperis, she also needs to file a new Application to Proceed in District Court Without Prepaying Fees or Costs by accurately completing form AO 239. TEXT ORDER entered by Magistrate Judge Douglas J. Quivey on November 12, 2025: Before the Court is Plaintiff's Motion to Amend Financial Affidavit in Support of Application to Proceed In Forma Pauperis. (Doc. 5). On November 7, 2025, the Court entered Judgment against Plaintiff dismissing her complaint without prejudice. (11-7-2025 Judgment). The basis for the dismissal was Plaintiff's failure to pay the filing fee in two installments as ordered on September 19, 2025. (9-19-2025 Order). Because the Motion to Amend was filed after Judgment was entered, the Motion is DENIED as moot. If Plaintiff wants to continue pursuing her claim, she needs to file a new complaint starting a new case. Semtek Int'l, Inc. v. Lockheed Martin Corp., 531 U.S. 497, 505-06 (2001) (explaining that the primary meaning of dismissal without prejudice is dismissal without baring the plaintiff from returning later to the same court with the same underlying claim). In an Order entered on 9/19/2025, United States Magistrate Judge Quivey entered an Order #3 denying Plaintiff's Motion for Leave to Proceed In Forma Pauperis while allowing her to make two payments with the first payment of $203 due on 10/1/2025 and the second payment of $202 due by 11/3/2025. The Order provided that failure to pay the filing fee would result in the case being dismissed without prejudice. Plaintiff has made no payment in satisfaction of the $405 filing fee. Therefore, this case is Dismissed without Prejudice. (FDS)
