TEXT ORDER entered by District Judge Jonathan E Hawley on 2/18/2026. On 1/12/2026, a Notice of Lawsuit and Request for Waiver of Summons and a Waiver of Service of Summons #13 was mailed to Defendant Susan Cole. It has been over 30 days, and Defendant Cole has not returned an executed Waiver of Service of Summons. The Clerk is directed to mail a second request for waiver of service to Defendant Cole. The Clerk is also directed to send a copy of this Text Order to the law firm of Heyl Royster Voelker & Allen, which represents Defendant Cole in other litigation in this District. If the second waiver is not returned within 30 days, the Court will order service upon Defendant Cole by the U.S. Marshal and will impose upon Defendant the expenses incurred in making service and the reasonable expenses of any motion required to collect those service expenses if Defendant does not show good cause for failing to sign and return the waiver requested by Plaintiff. See Fed. R. Civ. P. 4(d)(2)(A)-(B).(VH)

TEXT ORDER entered by District Judge Jonathan E Hawley on 1/22/2026. The Clerk of the Court has been informed by the Illinois Department of Corrections ("IDOC") that effective immediately, Plaintiff has been transferred to Vienna Correctional Center ("Vienna CC"). The IDOC conveyed this information simply as a courtesy to the Clerk. Plaintiff is reminded that he is under a continuing obligation to keep the Clerk and the opposing parties informed of any change in his location. Pursuant to Central District of Illinois Local Rule 16.3(K), every pro se plaintiff must notify the Clerk of this Court in writing of any change of address during the entire pendency of his case. It is not the Court's responsibility to independently maintain current addresses on all parties to pending actions. As a courtesy to Plaintiff, however, the Clerk is DIRECTED to send a copy of this Notice and the docket sheet to Plaintiff at Vienna CC and to update Plaintiff's address on the docket to Vienna CC. Plaintiff is ORDERED to file a notice with the Clerk to verify his current address by February 5, 2026. Failure to do so will result in dismissal of this action with prejudice.(VH)

MERIT REVIEW ORDER entered by District Judge Jonathan E Hawley on 1/12/2026. IT IS THEREFORE ORDERED: 1) According to the Court's Merit Review of Plaintiff's Amended Complaint under 28 U.S.C. Sec. 1915A, Plaintiff alleged sufficient facts to proceed on (1) an Eighth Amendment claim against Defendants Cole, Lindsay, and Adesanyn based on their alleged deliberate indifference to the treatment of his chronic back disease, hand injury on June 6, 2024, and the pain in his right fingers and thumb, and (2) a Monell claim against Defendant Wexford. Additional claims shall not be included in the case above, except in the Court's discretion on motion by a party for good cause shown under Federal Rule of Civil Procedure 15. 2) Defendant IDOC is DISMISSED WITH PREJUDICE for failure to state a claim under Federal Rule of Civil Procedure 12(b)(6) and 28 U.S.C. Sec. 1915A. The Clerk is directed to TERMINATE Defendant IDOC. 3) Plaintiff's Motion Seeking Status of Complaint #10 is MOOT. The Clerk is directed to enter the standard qualified protective order pursuant to the Health Insurance Portability and Accountability Act. See full written Order. (VH)

TEXT ORDER entered by District Judge Jonathan E Hawley on 10/14/2025. Plaintiff filed Complaint #1 on 9/23/2025. Prior to it undergoing merit review, Plaintiff now files a Motion for Leave to File an Amended Complaint #4 . Plaintiff's Motion #4 is GRANTED. The Clerk is directed to file the Amended Complaint and set the merit review deadline 30 days out. Plaintiff also filed a Petition to Proceed in forma pauperis #7 . Plaintiff asserts, under oath, that he has received no income whatsoever in the past 12 months. His prisoner trust fund ledgers, however, reveal that Plaintiff has $3,112.90 in his account. Plaintiff's petition is, at best, in error and, at worst, fraudulent. Plaintiff's Petition to Proceed in forma pauperis #7 is DENIED. Plaintiff will have 21 days in which to pay the $405 filing fee or submit a corrected petition identifying his sources of income. Failure to do either will result in the dismissal of this case, without prejudice.(VH)
