TEXT ORDER entered by Magistrate Judge Douglas J. Quivey on 2/20/2026: On January 6, 2026, the Court warned Plaintiff as it relates to Defendant City of Springfield, that he needed to either file proof of service on Defendant City of Springfield if the City had already been served by January 13, 2026, or, if Defendant City of Springfield had not yet been served, to effectuate service on the City by February 19, 2026. Plaintiff was warned that failure to do either would result in dismissal pursuant to Fed. R. Civ. P. 4(m). The reason Plaintiff was given two alternatives is because Plaintiff filed a document indicating the Defendant City of Springfield had been served, (Doc. #6 ), but the underlying document relates to Defendant Redpath and not to Defendant City of Springfield. It should also be noted that an earlier case making the same allegations, 25-cv-3217, was dismissed pursuant to Fed. R. Civ. P. 4(m) because Plaintiff Cook failed to timely perfect service. The Court will give Plaintiff ten (10) additional days until March 2, 2026, to either effectuate service on Defendant City of Springfield or show good cause for his failure. If Plaintiff fails to do either, at a minimum, Defendant City of Springfield will be dismissed without prejudice pursuant to Fed. R. Civ. P. 4(m). Plaintiff, however, is also put on notice that if he fails to effectuate service, he also runs the risk of dismissal with prejudice for failure to prosecute. See Link v. Wabash R.R. Co., 370 U.S. 626, 630 (1962) (explaining district courts have the inherent authority to dismiss a case sua sponte for want of prosecution). The basis of a dismissal with prejudice is the history of this case, what occurred in 25-cv-3217, and the Court taking judicial notice of numerous other cases pending against the City of Springfield in the Central District of Illinois where other plaintiffs have been able to successfully serve the City of Springfield. TEXT ORDER entered by Magistrate Judge Douglas J. Quivey on 1/6/2026: A review of the docket shows that Plaintiff had Defendant Redpath served on November 24, 2025, and Defendant Redpath's answer was due on December 15, 2025. It appears that Defendant City of Springfield was not served as docket entries #5 and #6 both relate to Defendant Redpath even though docket entry #6 says it is for Defendant City of Springfield. As to Defendant Redpath, district courts have the inherent authority to dismiss a case sua sponte for want of prosecution. Link v. Wabash R.R. Co., 370 U.S. 626, 630-31 (1962). See also Fed. R. Civ. P. 41(b). Accordingly, Plaintiff is given until January 20, 2026, to either move for default against Defendant Redpath or show cause for failing to do so. As it relates to Defendant City of Springfield, if Plaintiff has effectuated service on the City of Springfield, he is ordered to file proof of the service by January 13, 2026. If Plaintiff has not served the City of Springfield, he is ordered to do so within 90 days of the date the Complaint was filed, November 21, 2025, or the case will be dismissed without prejudice pursuant to Fed. R. Civ. P. 4(m).(BMG) Modified on 1/7/2026 to fix typographical error (BMG).
