Quivey on 8/28/2026: Before the Court is Plaintiffs' Motion for Five-Day Extension of Time to Respond and for Leave to file a Second Amended Complaint. (Doc. #28 ). The Motion is GRANTED in part and DENIED in part. Plaintiffs have until September 1, 2026, to respond to Defendants' Motion to Dismiss. Plaintiffs are reminded that motions for extension of time "must state whether opposing counsel has an objection to the motion." CDIL-LR 6.1. Future motions that do not state whether the opposing Party has an objection will be denied. Leave to File a Second Amended Complaint is denied without prejudice. Motions asking for different forms of relief, in this case a continuance and a motion to amend, must be filed as separate motions. Additionally, to file documents requiring leave of the Court, as with amended complaints, "the filing party must attach the proposed document as an exhibit to a motion to file". CDIL-LR 47.1(B).(BMG)

TEXT ORDER entered by Magistrate Judge Douglas J Quivey on 4/28/2026. Before the Court is Plaintiff Shaffer's Application to Proceed in District Court Without Prepaying Fees or Costs, (Doc. #4 ), and Plaintiff Mason's Application to Proceed in District Court Without Prepaying Fees or Costs. (Doc. #5 ). Both Applications state that each Plaintiff has $150.00 in cash or an account, no expenses, and nothing of value. The Court finds it unlikely that both Plaintiffs have exactly the same financial situation. Additionally, Plaintiff Mason did not sign his Application. The Applications are DENIED with leave to refile no later than May 15, 2026. The Plaintiffs are reminded that by signing and filing Applications they are doing so under the penalty of perjury. (JJK)
