April 21, 2026 Filing 12 MINUTE entry before the Honorable April M. Perry: Status hearing held 4/21/2026 on Plaintiff's petition to perpetuate testimony under Federal Rule of Civil Procedure 27(a). The Court explains to Plaintiff that under Rule 27(a), a motion to perpetuate testimony may only be filed in a district where the adverse party resides. According to the petition, Defendant Newrez d/b/a/ ShellPoint Mortgage Servicing resides in Springfield, Illinois, and that is where service was executed upon Defendant. After discussing this issue with Plaintiff, Plaintiff asks to transfer the case to the Central District of Illinois. Pursuant to 28 U.S.C. 1406, the Court finds that the interest of justice favors a transfer over a dismissal of this action. Accordingly, this case is ordered to be transferred forthwith to the Central District of Illinois. Civil case terminated on the docket of the Northern District of Illinois. Mailed notice. (jcc,)
