On July 20, 2026, Defendant David DeCelles [Defendant] filed in this Court a Notice of Removal from Sangamon County Circuit Court. See d/e #1 .Defendant's Notice (d/e #1 ) states that this matter is properly removed under 28 U.S.C. Section 1442(a), which states, in relevant part: "A civil action or criminal prosecution that is commenced in a State courtmay be removedto the district court of the United States for the district and division embracing the place wherein it is pending" by certain defendants, including any named "officer of the courts of the United States, for or relating to any act under color of office or in the performance of his duties." 28 U.S.C. Section 1442(a)(3). The Civil Cover Sheet attached to Defendant's Notice (d/e #1 ) cites "U.S. Government Defendant" as the sole asserted basis of this Court's purported jurisdiction.However, Petitioner Roger Shekar's ["Petitioner"] Petition makes no reference to Defendant's official office or capacity or to any actions by Defendant "for or relating to any act under color of office or in the performance of his duties." See 28 U.S.C. Section 1442(a)(3). Therefore, as this Court lacks jurisdiction over this matter, this case is REMANDED back to Sangamon County Circuit Court. (RAH)
