Filing 20 ORDER Entered by Judge Michael M. Mihm on 04/26/2010 Powell's Title VII Complaint is untimely, equitable tolling is not warranted, and Zancanell's Motion for Summary Judgment is therefore granted. The Court believes it is unfortunate that Powell's case will not be heard on the merits as a result of this ruling, but the application of the law to the facts of this case justify such a result. For the reasons set forth above, Zancanelli's 6 Motion for Summary Judgment is GRANTED. and Powell's 1 Complaint is DISMISSED. (TP, ilcd) |
