TEXT ORDER: Plaintiff Branden Colvin, Sr., a detainee at the Rock Island County Jail, has filed at least three cases which were dismissed for failure to state a claim or as frivolous or malicious. Colvin v. RIPD, 18-cv-4102 (C.D. Ill.)(8/23/18 order dismissing for failure to state a claim); Colvin v. American Bank & Trust, 18-cv-4097 (C.D. Ill.)(8/23/18 order dismissing for failure to state a claim); Colvin v. Doe, 18-cv-4103 (C.D. Ill.)(7/24/18 and 8/14/18 order dismissing as frivolous, malicious and for failure to state a claim); Colvin v. Rock Island Police Dept., 16-cv-4118 (C.D. Ill.)(7/19/17 order granting motion to dismiss for failure to state a claim); Colvin v. Chester Mental Health, 17-cv-257 (S.D. Ill.)(4/25/17 order dismissing case as frivolous). That means that Plaintiff cannot proceed in this case unless he is under imminent danger of serious physical injury. 28 U.S.C. 1915(g). However, Plaintiff alleges that he is "being antagonized-starved: Have not eaten anything in about 7 days." This Court has called the Rock Island County Sheriff, who reports that Plaintiff is being provided regular meals, has been eating, has not lost weight, and has been seeing mental health professionals from the Robert Young Mental Health Facility. In light of this information from the Sheriff, Plaintiff's allegations are too vague to infer that Plaintiff is in imminent danger of serious physical injury. Accordingly, Plaintiff cannot proceed in forma pauperis. By September 26, 2018, Plaintiff is directed to pay the $400 filing fee or this case will be dismissed without prejudice. Within 21 days of the entry of this order, Plaintiff must pay the $400 filing fee in full or file a petition to proceed in forma pauperis with attached trust fund ledgers for the last 6 months. Failure to comply without good cause will result in dismissal of this case without prejudice, and the Plaintiff will still be responsible for payment of the filing fee. See 28 U.S.C. Sec. 1914.
