TEXT ORDER entered by Judge Colin Stirling Bruce on 12/14/2018. Plaintiff's motion for leave to amend his Complaint #29 is DENIED. The Court does not accept piecemeal amendments to pleadings. If Plaintiff desires to amend his Complaint to add a Defendant, to add a claim, or to substitute a Defendant for a Defendant previously identified as "John Doe," he should file a motion seeking leave to do so in which he identifies the changes that he desires to make in his Complaint. In addition, Plaintiff should attach a complete, proposed amended complaint that, if granted leave to file, will completely replace his original Complaint and will stand on its own without reference to or reliance upon his Original Complaint. Flannery v. Recording Indus. Ass'n of Am., 354 F.3d 632, 638 n.1 (7th Cir. 2004). The proposed Amended Complaint should explain what Defendants did or did not do, including the proposed new Defendant(s), and why their actions or inactions violated Plaintiff's constitutional rights. TEXT ORDER entered by Judge Colin Stirling Bruce on 12/14/2018. Plaintiff's motion for order for deposition #24 is DENIED. Plaintiff asks the Court to locate and to arrange for him to depose a physician's assistant who previously treated him. Plaintiff desires to treat this physician's assistant as an expert witness. Although the Court has allowed Plaintiff to proceed in this case in forma pauperis, that status does not alleviate Plaintiff from bearing the normal and ordinary costs associated with litigation, including deposition costs. There may also be a fee from the witness if Plaintiff desires to treat the physician's assistant as an expert witness that Plaintiff would need to bear. The Court will not arrange or allow Plaintiff to depose anyone unless and until he can demonstrate that he can pay the costs associated with conducting a deposition. Therefore, Plaintiff's motion is denied until he can make such a showing. (KE, ilcd) |

TEXT ORDER entered by Judge Colin Stirling Bruce on 10/17/2018. This Court has instituted a reduced filing fee procedure for indigent plaintiffs who are institutionalized but who are not prisoners as defined in 28 USC Section 1915(h). A reduced payment will be assessed of 50% of such plaintiff's average monthly income for the six months preceding the filing of the complaint (not to exceed the $400 filing fee). Income includes all deposits from any source. Plaintiff Kevin Stanbridge is currently detained at Rushville Treatment and Detention Facility, and is thus subject to the reduced payment procedure. Plaintiff's ledgers for the past six months show an average monthly income of $187.81. Plaintiff is ordered to send an institutional check or money order in the amount of $93.90, payable to Clerk, U.S. District Court within 30 days from the date of this order. The reduced fee may be waived if the plaintiff, within 14 days of this order, files a motion to waive the fee and demonstrates good cause for such waiver. (KE, ilcd) |
