Filing 14 MERIT REVIEW ORDER entered by Chief Judge James E. Shadid on 1/30/2019. IT IS THEREFORE ORDERED: 1) Plaintiff's complaint is dismissed for failure to state a claim upon which relief can be granted pursuant to 28 U.S.C. 1915A. 2) If Plaintiff believes he can clarify his claim concerning the occasion he was left shackled in a bullpen for several hours, he may file an amended complaint within 21 days or on or before 2/20/2019. If Plaintiff does not file an amended complaint on or before 2/20/2019 or does not follow the Court's directions, his case will be dismissed with prejudice. 3) The Clerk of the Court is directed to dismiss Defendants Judge Sara Darrow, the United States Marshal Service, the "Rock Island Courthouse Auxiliary Marshall's Assistants," and Assistant United States Attorneys (AUSA) Don Allegro, Meredith DeCarlo, and Kevin Knight for failure to state a claim upon which relief can be granted. Defendant United States Marshal Jackson will remain in the case until Plaintiff clarifies any potential claim. 4) Any motions concerning staying the case due to the government shutdown are now denied as moot. TEXT ORDER - Entered by Judge Colin Stirling Bruce on 1/3/2019 granting #3 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $27.83. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff`s account to the Clerk of Court. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court.
