May 6, 2019 Opinion or Order TEXT ORDER granting #6 Petition to Proceed In Forma Pauperis. Plaintiff's trust fund ledgers indicate he has no funds to make an initial partial payment of the filing fee. Pursuant to 28 U.S.C. Section 1915(b)(4), the initial partial filing fee is waived. The agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. April 23, 2019 Opinion or Order TEXT ORDER entered by Judge Colin Stirling Bruce on 4/23/2019. Plaintiff has filed a motion to proceed in forma pauperis (IFP) claiming he has received no income from gifts, a prison job, or any other source in the last 12 months. #4 . Plaintiff's motion is inaccurate at best. The Court has received Plaintiff's Trust Fund Ledgers demonstrating he has received more than a $641 in gifts over the last six months. Plaintiff's motion is therefore denied. #4 . Plaintiff must either pay the $400 filing fee in full or file a new motion to proceed IFP with accurate information within 14 days. Plaintiff must also indicate if he has any outside accounts. In addition, Plaintiff must state whether he has received a settlement in any other case in the last 12 months, or whether he anticipates a settlement check in the next 6 months. Plaintiff is reminded any motion filed with the Court must contain accurate, truthful information. Intentionally misleading the Court could result in sanctions or an inability to proceed IFP. If Plaintiff fails to pay the $400 filing fee or file a new IFP motion with accurate information on or before May 7, 2019, his case will be dismissed without prejudice. (JS, ilcd)
