TEXT ORDER entered by Judge Sue E. Myerscough on 10/4/2019. Plaintiff sent a "motion for extension of time" to the Clerk, asking for an extension to file a complaint. Plaintiff may be asking for an extension of the two-year statute of limitations that governs civil rights actions filed under 42 U.S.C. Sec 1983. Plaintiff's motion is denied because the Court cannot grant extensions of the statute of limitations. However, the statute of limitations would not prevent the filing of a complaint. The statute of limitations is generally an issue that the Court does not decide unless raised by the defendants. Plaintiff has until November 19, 2019 to file a complaint, but that does not mean that Plaintiff's complaint will be considered timely. If Plaintiff's complaint states a federal claim, the case will be sent for service on defendants, who may raise the statute of limitations defense. The Court will then decide whether Plaintiff's complaint is timely. If Plaintiff does not file a complaint by November 19, 2019, this case will be dismissed without prejudice and closed. The clerk is directed to send Plaintiff a complaint form with instructions. No filing fee is assessed until further order of Court. (KE, ilcd)
