MERIT REVIEW ORDER entered by Judge James E. Shadid on 1/28/2020. IT IS THEREFORE ORDERED: 1) Plaintiff's complaint is dismissed as a violation of Rule 8 of the Federal Rules of Civil Procedure which calls for a short and plain statement of Plaintiff's intended claims. See Fed.R.Civ.P. 8(a)(2). 2) Plaintiff must file an amended complaint in compliance with this order within 21 days or on or before February 19, 2020. If Plaintiff fails to file his amended complaint on or before February 19, 2020, or fails to follow the Court's directions, his case may be dismissed. Plaintiff should use the complaint form provided. 3) Plaintiff is reminded he must immediately notify the Court in writing of any change in his mailing address and telephone number. Failure to provide this information could result in the dismissal of his lawsuit. 4) The Clerk of the Court is to provide Plaintiff with a blank complaint form and reset this case for an internal merit review within 30 days. TEXT ORDER granting #5 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $29.02. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff is directed to make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. TEXT ORDER entered by Judge James E. Shadid on 12/5/2019. Plaintiff has filed a motion to proceed in forma pauperis (IFP) claiming he has received no income from gifts, a job, an outside account, or any other source in the last 12 months #3 . However, Plaintiff's Trust Fund Ledger indicates Plaintiff has received $870.71 in gifts and other income. Plaintiff is reminded any motion filed with the Court must contain accurate, truthful information. Intentionally misleading the Court could result in sanctions or an inability to proceed IFP. Therefore, Plaintiff's motion is denied #3 . Plaintiff must either pay the $400 filing fee in full or file a new motion to proceed IFP with accurate information within 14 days or this order. Plaintiff must list any income from any source and must clearly indicate if he has any outside accounts. In addition, Plaintiff must state whether he has received a settlement in any other case in the last 12 months, or whether he anticipates a settlement check in the next 6 months. If Plaintiff fails to pay the $400 filing fee or file a new IFP motion with accurate information on or before December 19, 2019, his case will be dismissed without prejudice.(SAG, ilcd)
