TEXT ORDER: Assistant United States Attorney Greggory R. Walters was automatically added as counsel of record in this matter. However, as Petitioner is in state custody, the federal government has no interest in this matter and Mr. Walter's Motion to withdraw as counsel of record #3 is GRANTED. TEXT ORDER: Petitioner has filed a Petition for writ of habeas corpus pursuant to 28 U.S.C. 2241 #1 and a Motion for leave to proceed in forma pauperis #2 , both signed on December 18, 2019. The Petition raises claims related to those presented in Petitioner's earlier filed petition for writ of habeas corpus pursuant to 28 U.S.C. 2241 (signed December 16, 2019) in Case No. 19-cv-4253, which is pending in this district before Chief Judge Darrow. In that case, Chief Judge Darrow ordered Petitioner to pay the $5 fee or file a motion to proceed in forma pauperis. The Court finds that this second-in-time habeas petition should not proceed as a separate case when his first one is still pending. The proper course is for Petitioner to file an amended petition in his original case to include these additional claims. This will allow efficient use of judicial resources and prevent any conflicting orders or judgments. As Petitioner is proceeding pro se, however, the Court will correct Petitioner's procedural mistakes for him. Accordingly, the Clerk is DIRECTED to file the Petition #1 and Motion for leave to proceed in forma pauperis #2 in Petitioner's original case, 19-cv-4253, and CLOSE this case. Entered by Judge Sue E.
