TEXT ORDER entered by Judge James E. Shadid on 12/21/2020. On October 30, 2020, the Court noted Plaintiff's complaint was improperly filed as a complaint in both the Southern District of Illinois and the Central District of Illinois. Since venue was proper in the Southern District, the Central District case was dismissed and the Court waived the collection of any filing fees in this action only. See October 30, 2020, Text Order. Plaintiff has now filed a motion checking the status of his fees #5 . Plaintiff notes the Trust Fund Office still sent $25.11 for payment of the previously accessed initial partial filing fee. The motion is granted #5 . The Finance Department is directed to refund the $25.11 to the Plaintiff's Trust Fund Account. In addition, the clerk is directed to send a copy of this order along with a copy of the October 30, 2020, Order to the attention of the Trust Fund Office at Plaintiff's facility. No further fees should be collected in this action. (SAG, ilcd)

TEXT ORDER entered by Judge James E. Shadid on 10/30/2020. On October 29, 2020, the pro se Plaintiffs complaint was improperly filed in both the Central District of Illinois (Wiley, 20-4224), and in the Southern District of Illinois (Wiley, 20-1140). All of Plaintiff's claims appear to involve Pinckneyville Correctional Center. All but Defendant "Hill Psych Doctor" also appear to be at Pinckneyville Correctional Center and this Defendant is not mentioned in the body of the complaint. Only one Court should review Plaintiff's complaint and determine if Plaintiff has articulated a constitutional violation, whether he can combine claims in one complaint, and whether any claim should be severed and sent to a different court for proper venue. Filing the complaint in two different jurisdictions leads to unnecessary confusion, multiple repetitive filings, and additional filing fees for the Plaintiff. Since Plaintiff's claims involve Pinckneyville, the Court will dismiss the lawsuit filed in the Central District of Illinois in its entirety and Plaintiff may proceed with his complaint in the Southern District of Illinois. In addition, since the complaint filed in the Central District appears to be a filing error, the Court will waive the collection of any filing fee only in this action: Wiley, 20-4224. This case is terminated. The Clerk is directed to send a copy of this order to the Trust Fund Office and to the litigation coordinator at Plaintiff's facility.(SAG, ilcd)

TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $25.11. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. Plaintiff is ultimately responsible for ensuring that the initial partial filing fee and required monthly payments are made. Failure to do so may result in dismissal of this case. The Clerk is directed to mail a copy of this order to Plaintiff's place of confinement, to the attention of the Trust Fund Office, and to Plaintiff. Prisoner Prepayment due by 11/30/2020.
