TEXT ORDER entered by Judge Colin Stirling Bruce on 4/8/2021. On February 26, 2021, the Court granted Plaintiff's motion for leave to proceed in forma pauperis and imposed an initial, partial filing fee of $33.28 in order for Plaintiff to litigate this case. The Court gave Plaintiff thirty (30) days to pay this fee. As of today, Plaintiff has not paid this fee. However, Plaintiff has sent a letter to the Court blaming the Henry County Jail for failing or refusing to process this payment from his inmate trust fund account and failing or refusing to send the payment to the Court. Accordingly, the trust fund department at the Henry County Jail is ordered to process and to send the initial, partial filing fee of $33.28 to the Clerk of the Court on Plaintiff's behalf from his inmate account. If the Henry County Jail cannot comply with this Order, Defendants should file a statement or notice with the Court indicating why they cannot comply. Jail officials or Defendants should accomplish one of these tasks within twenty-one (21) days from the date of this Order. If Plaintiff needs to take any actions with Jail officials in order to ensure that the payment is processed and made, Plaintiff should do so as, ultimately, it is his responsibility to ensure that the initial, partial filing fee is made. Sec 1915A, the Court finds that Plaintiff's Complaint states two claims: (1) an excessive force claim against Defendants Deputies Pillard, Pettifer, and Millroy in violation of his Fourteenth Amendment rights and (2) a medical claim against Defendant Lessard in violation of his Fourteenth Amendment rights. Any additional claim(s) shall not be included in the case, except at the Court's discretion on motion by a party for good cause shown or pursuant to Federal Rule of Civil Procedure 15. The Clerk is directed to enter the standard qualified protective order pursuant to the Health Insurance Portability and Accountability Act. The Clerk is directed to attempt service on Defendants pursuant to the Court's standard procedures. Plaintiff must timely pay the initial, partial filing fee of $33.28 that the Court imposed in this case. If Plaintiff fails to pay this fee timely, the Court will dismiss this case. TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis entered by Judge Colin Stirling Bruce on 2/26/2021. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $33.28. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff`s account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full. Plaintiff is ultimately responsible for ensuring that the initial partial filing fee and required monthly payments are made. Failure to do so may result in dismissal of this case. The Clerk is directed to mail a copy of this order to Plaintiff`s place of confinement, to the attention of the Trust Fund Office, and to Plaintiff. Prisoner Prepayment due by 3/29/2021 (KE) |
