June 25, 2021 Opinion or Order TEXT ORDER Entered by Judge Sue E. Myerscough on 6/25/2021. Leroy McMahill has sent a letter to the Clerk which appears to allege that he was subjected to excessive force at the Knox County Jail. Whether Plaintiff intends to pursue a lawsuit at this time is not clear. Plaintiff is advised that if he does intend to file a case, he must either pay the $402 filing fee or file a petition to proceed in forma pauperis. Even if Plaintiff is granted leave to proceed in forma pauperis, a $350 filing fee will be taken from his prison account in installments, regardless of the outcome of the case. Plaintiff is further advised that he cannot pursue a lawsuit until he exhausts his available administrative remedies, which means timely following the grievance procedures at the jail and pursuing all possible appeals. 42 U.S.C. 1997e(a). Additionally, if Plaintiff's case is dismissed for any reason listed in 28 U.S.C. 1915(g), such as for failure to state a claim or as frivolous, the plaintiff will incur a "strike" under 28 U.S.C. 1915(g). Accumulation of three strikes will bar the plaintiff from proceeding in forma pauperis in future cases unless he is in imminent danger of serious physical injury. 28 U.S.C. 1915(g). The clerk is directed to send Plaintiff a 1983 packet. Plaintiff is directed to file an amended complaint by July 23, 2021, setting forth what happened and, if known, the names of the individuals who allegedly violated Plaintiff's rights. Also by July 23, 2021, Plaintiff is directed to file a petition to proceed in forma pauperis or pay the $402 filing fee. Failure to follow the Court's orders will result in dismissal of this case without prejudice. (KB)
