TEXT ORDER entered by Judge James E. Shadid on 9/7/2021. The pro se Plaintiff filed a complaint and a Motion for Leave to Proceed In Forma Pauperis (IFP) on August 27, 2021 #1 , #3 . Plaintiff stated his only income was gifts from family and friends, although he provided no amount. Plaintiff further stated he had about $500 in his account, but he had been unable to obtain a copy of the required Trust Fund Ledgers #3 . The Clerk of the Court obtained a copy of those ledgers from Plaintiff's correctional center which demonstrate Plaintiff had $737.91 when he filed his complaint #6 . In addition, Plaintiff spent $396. 90 on commissary items in the days right before he filed his complaint in August of 2021. Therefore, the motion for leave to proceed IFP is denied #3 . Plaintiff must pay the full $402 filing fee within 21 days or on or before September 28, 2021. If Plaintiff fails to take any action on or before September 28, 2021, his case will be dismissed. (SAG)
