TEXT ORDER entered by Chief Judge Sara Darrow on December 1, 2021. Plaintiffs have #2 moved to cancel their case and obtain a refund of the filing fee. In the #1 Complaint, Plaintiffs alleged that that venue was proper in the Central District of Illinois because their "injury was suffered entirely within Knox County, Illinois in the Central District of Illinois." #1 Compl. para 4. In the instant motion, however, Plaintiffs explain that the case "is properly venued in the Northern District of Illinois, as the underlying events did not occur in Knox County as believed, but rather in LaSalle County, Illinois." Mot. Refund 1. Plaintiffs' #2 motion is GRANTED to the extent that it seeks dismissal of the case. See Fed. R. Civ. P. 41(a)(1)(A)(i). But the refund request is DENIED because Plaintiffs' payment of the filing fee is attributable to Plaintiffs' own factual error regarding where the events of this case occurred rather than a payment-system malfunction. See IV Guide to Judiciary Policy, ch. 6, 650.10 ("The Judicial Conference's current policy on refunding filing fees, in effect since 1949, has been broadly interpreted to generally prohibit refunds of fees due upon filing, even if a party filed the case in error...."). The Clerk is directed to close the case. (MLM) |
