TEXT ORDER entered by Judge Colin Stirling Bruce on 1/31/2022. Plaintiff filed a complaint #1 and a petition to proceed in forma pauperis ("IFP") #3 . After reviewing Plaintiff's trust fund ledgers, the Court granted Plaintiff's IFP petition, imposed a reduced filing fee of $23.79, and directed the Henry County Jail to remit that amount. The Jail has since filed a notice #7 , informing the Court that from June 1 to December 28, 2021, Plaintiff transferred $639 on his Securus phone account, which the Jail cannot access. Plaintiff's trust fund ledgers show he routinely withdrew funds from his Securus account from October 21 to December 14, 2021, to pay for commissary items totaling over $400 and other purchases. After the Court imposed the reduced filing fee, Plaintiff filed a second IFP petition, claiming he is destitute and receives no monies from outside sources that his trust fund ledger activity contradicts. Accordingly, the Court STRIKES Plaintiff's second IFP petition #9 and DIRECTS Plaintiff to remit the imposed partial filing fee within fourteen days of the entry of this ORDER. Acceptable forms of payment include money orders or cashier's checks, which should be made out to the "U.S. District Court" and mailed to 201 S. Vine Street, Urbana, IL. 61802. If Plaintiff requires additional time to comply, he may file a motion for an extension on or before the deadline date. Failure to timely comply with the Court's direction will result in the dismissal of this case without prejudice. (KE) |

TEXT ORDER granting #3 Petition to Proceed In Forma Pauperis entered by Judge Colin Stirling Bruce on 12/15/2021. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $23.79. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff`s account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month`s income credited to Plaintiff`s account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff`s account exceeds $10, until the filing fee of $350 is paid in full.
