TEXT ORDER entered by Chief Judge Sara Darrow on 2/2/2023. Plaintiff previously filed numerous motions seeking summary judgment or default judgment and motions seeking to amend his complaint. As the Court pointed out in its previous orders denying this relief, Plaintiff did not comply with the rules applicable to these types of motions. Plaintiff has since filed five motions #107 #110 #114 #115 #116 #118 #119 seeking the same or similar relief on the same grounds and because Defendants Ward and Gerischer apparently pled guilty to criminal charges arising out of these events. Plaintiff's present motions do not cure the deficiencies the Court outlined in its previous orders. Plaintiff's motions #107 #110 #114 #115 #116 #118 #119 are therefore DENIED. Plaintiff is advised that he will have an opportunity to file a motion for summary judgment later in the proceedings if he is so inclined, but he must first allow the discovery process outlined in the Courts Scheduling Order to take place. See #112 . Plaintiffs motion #120 seeking leave to appeal in forma pauperis is DENIED as moot. The Court granted Plaintiff's previous petition to proceed in forma pauperis in its Text Order entered Feb. 24, 2022. Plaintiff's Motion for Appointment of Counsel #121 is GRANTED to the extent that Plaintiff seeks the Court to attempt to find counsel on his behalf. Plaintiff is advised that he does not have a statutory or constitutional right to counsel in a civil case, and the best the Court can do is ask an attorney to volunteer his or her time. The number of pro se litigants seeking pro bono counsel greatly exceeds the number of attorneys willing to volunteer. The Court cannot guarantee that it will find counsel willing to take Plaintiff's case. The Court has also received executed magistrate judge consent forms from Plaintiff and Defendant Gerischer. Counsel for Defendants Ward and O'Melia shall inform the Court within seven days of this Order of their positions regarding consent to proceedings before the magistrate judge.(ANW) |

TEXT ORDER Entered by Chief Judge Sara Darrow on 10/26/2022. Plaintiff's Motion for Leave to Add More Defendants #57 is DENIED. If Plaintiff desires to amend his complaint, he must file a proposed amended complaint that contains all allegations against all defendants he wishes to sue. The Court does not accept piecemeal amendments. Plaintiff's letters #54 #58 #65 are DENIED for the same reason to the extent that they seek leave to file an amended complaint. Defendant Omelia's Motions to Strike #60 #66 are DENIED. Given Plaintiff's pro se status, and the Court's duty to liberally construe the pleadings, the Court sees no reasons to strike Plaintiff's letters. Defendant Omelia's Motion for Extension of Time #64 is GRANTED. Defendants shall file their answer by November 14, 2022. Defendants Ward and Gerischer have not yet returned executed waivers of service. Clerk is directed to send second requests for waiver of service and a copy of this Order to these defendants. TEXT ORDER Entered by Chief Judge Sara Darrow on 3/8/2022. Plaintiff sent to the Clerk a large envelope containing a large amount of rolled up toilet paper. The outside of the roll had a note advising the recipient to wear gloves and a mask while unrolling it and the innermost section of the roll contained feces. Plaintiff previously sent a piece of toilet paper with the word "butt" written on it that appeared to be soiled with blood and feces. Plaintiff is directed to stop sending anything to the Court other than unsoiled legal pleadings. If Plaintiff sends any items, including legal pleadings, that contain human waste, blood, or other bodily fluids to the Clerk, the Court will consider sanctions against Plaintiff that may include dismissal of these claims with prejudice.
