The Clerk is directed to update the docket to reflect that Defendant's name is Walmart Inc. The Court will attempt service on Defendant by mailing a request to waive service. To request a waiver of service of summons from a defendant that is a corporation or association, a notice and request must be addressed and sent to "an officer, a managing or general agent, or any other agent authorized by appointment or by law to receive service of process." Fed. R. Civ. P. 4(d)(1)(A)(ii). TEXT ORDER entered by Chief Judge Sara Darrow on April 5, 2022. Plaintiff Peggy Janik's #2 petition to proceed in forma pauperis is DENIED WITHOUT PREJUDICE because it contains inconsistencies. Plaintiff reports no average monthly income from employment from February 2021 to February 2022, #2 Petition 1 (asking the applicant to list average monthly income from the past 12 months), but also reports that she was employed at Goodwill Industries until July 23, 2021, id. at 2. She reports that she had no monthly pay from that employment. Id. But it appears that may be a typo; presumably she made at least some income from her job with Goodwill Industries. Id. And if she had an income for at least some portion of the period between February 2021 and February 2022, she should have listed an average amount of income from employment even if she received no employment income at all during some of those months. Plaintiff may submit a new petition that accurately reflects her average monthly income from the past year and any monthly pay from Goodwill Industries by May 5, 2022. (AK) |
