TEXT ORDER granting #6 Petition to Proceed In Forma Pauperis. Pursuant to 28 U.S.C. Section 1915(b)(1), Plaintiff is assessed an initial partial filing fee of $25.41. The agency having custody of Plaintiff is directed to forward the initial partial filing fee from Plaintiff's account to the Clerk of Court within 30 days of this order. After payment of the initial partial filing fee (or immediately if no funds are available for that payment) the agency having custody of Plaintiff shall make monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account to the Clerk of Court. Income includes all deposits from any source, including gifts. The agency having custody of the plaintiff shall forward these payments each time Plaintiff's account exceeds $10, until the filing fee of $350 is paid in full. The Clerk is directed to mail a copy of this order to Plaintiff's place of confinement, to the attention of the Trust Fund Office, and to Plaintiff. Prisoner Prepayment due by 9/6/2022. TEXT ORDER entered by Judge James E. Shadid on 7/28/2022. The Court has received a complaint and a copy of Plaintiff's Trust Fund Ledger #1 , #3 . Plaintiff's complaint appears to be missing pages. The Court has received "1 of 5" and "2 of 5," but the remaining 44 pages are exhibits. Therefore, the Court will strike the complaint and allow Plaintiff 21 days to file a complete complaint. Plaintiff is reminded his complaint must NOT include exhibits. Instead, all claims and defendants must be clearly identified in the body of Plaintiff's complaint. See Fed.R.Civ.P. 8 (complaint must include a short and plain statement of the claims). Plaintiff must also clearly state how each Defendant was involved in his claim. In addition, while Plaintiff has provided a copy of his Trust Fund Ledger, he has not either paid the $402 filing fee in full or provided an IFP motion. An IFP motion must state any income Plaintiff receives including income from gifts. Therefore, the Court will also allow Plaintiff 21 days to either pay the filing fee in full or file a motion to proceed IFP. The clerk is to provide Plaintiff with a blank complaint form and a blank IFP form. If Plaintiff fails to file a complete complaint or either pay the filing fee in full or file an IFP motion within 21 days or on or before 8/18/2022, his case will be dismissed without prejudice.(SAG)
