January 24, 2023 Opinion or Order TEXT ORDER entered by Chief Judge Sara Darrow on January 24, 2023. Plaintiff Robert Juarez has filed a #3 Motion to Request Counsel, requesting the appointment of counsel and listing the names of attorneys who have declined to represent him. Under the federal in forma pauperis ("IFP") statute, "[t]he court may request an attorney to represent any person unable to afford counsel." 28 U.S.C. 1915(e)(1). But Plaintiff is not proceeding IFP--he paid the full filing fee, and he has not filed a motion to proceed IFP. See also #3 Mot. 1-2 (failing to fill out the section of the form discussing IFP applications). And, beyond checking a box stating that he is "unable to afford the services of an attorney," id. at 1, he provides no information about his finances such that the Court could conclude he is unable to afford counsel. Nor does he identify any other basis under which he may be appointed counsel. For these reasons, Plaintiff's #3 Motion to Request Counsel is DENIED without prejudice. Should his circumstances change, he may file a motion to proceed IFP and may seek the appointment of counsel at that time. (AAK)
