December 20, 2022 Opinion or Order TEXT ORDER entered by Judge James E. Shadid on 12/20/2022. Plaintiff filed his complaint on December 5, 2022 #1 . Plaintiff now says he would like to "withdraw the portion of my suit regarding the use of the legal library," because he has now learned there is an alternative #6 . First, if Plaintiff is asking to dismiss his ENTIRE lawsuit, he must file a motion to voluntarily dismiss. Second, if Plaintiff is only asking to dismiss one claim, he must file an amended complaint clarifying his surviving claims and defendants to avoid confusion. The Court does not allow piecemeal attempts to amend a complaint. The motion is therefore denied #6 . On or before January 9, 2023, Plaintiff must either file a motion to voluntarily dismiss his entire lawsuit, or he must file a revised complaint. The Clerk is to provide Plaintiff with a blank complaint form and reset the internal merit review deadline within 30 days of this order.(SAG)
