TEXT ORDER entered by Judge James E. Shadid on 1/6/2023. The Clerk of the Court received a letter addressed to a Central District of Illinois Judge which complained about conditions at the East Moline Correctional Center #1 . The letter was purportedly signed by the Plaintiff. Based on the allegations, the letter was filed as a complaint pursuant to 42 U.S.C. 1983, and Plaintiff was advised he must either pay the $402 filing fee or file a motion to proceed in forma pauperis. See December 19, 2022 Order. The Clerk has now received a second letter which has been filed as a Motion to Dismiss #3 . The second letter is in a different handwriting, but again purports to be signed by the Plaintiff. Plaintiff states he has not filed any complaints, motions, or other documents with the Court; he does not intend to pursue a lawsuit; and he will not pay any filing fee. The second letter is also from the East Moline Correctional Center and includes the same inmate number. Whether or not Plaintiff filed the first letter, he did not intend to open a lawsuit. Therefore, this case is dismissed in its entirety without prejudice and no filing fee will be owed. (SAG) |

TEXT ORDER entered by Judge James E. Shadid on 12/19/2022. Plaintiff has filed a Complaint but has not paid the $402 filing fee nor filed a petition to proceed in forma pauperis. Within 21 days of the entry of this order, Plaintiff must pay the $402 filing fee in full or file a petition to proceed in forma pauperis with attached trust fund ledgers for the last 6 months. Failure to comply without good cause will result in dismissal of this case without prejudice, and the Plaintiff will still be responsible for payment of the filing fee. See 28 U.S.C. Sec. 1914. The Clerk is directed to send Plaintiff the forms for proceeding in forma pauperis.(SAG) |
