TEXT ORDER entered by Judge Colin Stirling Bruce on 2/3/2023. Plaintiff's motion for leave to proceed in forma pauperis #3 is DENIED with leave to refile. The Court has learned that Plaintiff has or soon will be released from custody. Therefore, Plaintiff's trust fund ledgers and his IFP petition needs to be updated. Accordingly, Plaintiff's motion is denied with leave to re-file if he intends to continue to litigate this case. The Clerk of the Court is directed to send the forms necessary for Plaintiff to move for leave to proceed in forma pauperis now that he is (or soon will be) no longer incarcerated. If Plaintiff does not either pay the filing fee or re-move for leave to proceed IFP by February 17, 2023, the Court will dismiss this case. (KE) |
