TEXT ORDER entered by Chief Judge Sara Darrow on January 26, 2023. 28 U.S.C. 1915(a)(1) allows a court to authorize commencement and prosecution of a suit without prepayment of fees by a person who submits an affidavit stating her assets and that she is unable to pay such fees. See also Holly v. Wexford Health Servs., Inc., 339 F. App'x 633, 63536 (7th Cir. 2009) ("A district court may allow an indigent plaintiff to file a lawsuit without prepaying the required fees if the plaintiff submits an affidavit with a statement of his assets and attests that he is too poor to pay."). Plaintiff has filed #2 Form AO 240, the short form of the application to proceed in district court without prepaying fees or costs, but this Court requires Form AO 239, the long form. The #2 application is therefore DENIED without prejudice. The Clerk is directed to mail Plaintiff a copy of Form AO 239. Plaintiff may either pay the filing fee or file Form AO 239 by February 9, 2023. The Clerk is additionally directed to change Plaintiff's name on the docket to Kenneth Stulz to match the #1 complaint and #2 application. (AV) |
