Filing 9 Letter from Plaintiff James Engle. (JJK) |
TEXT ORDER entered by Chief Judge Sara Darrow on 5/9/2023. Two non-party detainees have filed motions #6 #7 seeking to join this case as plaintiffs. Fed. R. Civ. P. 20 permits individuals to proceed as plaintiffs in the same action if they seek relief "with respect to or arising out of the same transaction, occurrence, or series of transactions or occurrences" and "any question of law or fact common to all plaintiffs will arise in the action." Fed. R. Civ. P. 20(a). District courts have "considerable flexibility in managing and structuring civil litigation for fair and efficient resolution of complex disputes." UWM Student Ass'n v. Lovell, 888 F.3d 854, 863 (7th Cir. 2018). A court "may deny joinder under [Fed. R. Civ. P. 20] if the addition of the party... will not foster the objectives of the rule, but will result in prejudice, expense, or delay." Id. (quotations omitted). Although the non-parties appear to seek similar relief, the relatively temporary nature of pretrial confinement and the logistics of litigating a case with multiple pro se plaintiffs will not promote the efficient resolution of these issues. In addition, each pro se plaintiff must pay a separate filing fee. The motions #6 #7 are DENIED. If the non-parties desire to seek the relief stated in their motions, they should file their own separate lawsuits. As a courtesy to the non-party detainees, Clerk is directed to send a copy of this Text Order to each non-party detainee at the return address listed on their motions along with a blank 1983 form.
