TEXT ORDER entered by Judge Joe Billy McDade on 7/14/2023. On 6/5/23 Plaintiff filed a complaint but did not pay the $402 filing fee or file a petition to proceed in forma pauperis. On 6/5/23 this Court ordered Plaintiff to pay the filing fee in full or file a petition to proceed in forma pauperis within 21 days, or the case would be dismissed. That same day the Clerk also issued to Plaintiff a Notice of Case Opening. The Court's letter to Plaintiff with the 6/5 Order and Notice was returned as undeliverable on 6/20/23. That same day the Court directed Plaintiff to update his address within 14 days or face dismissal of this action. See also, CDIL-LR 16.3(K) ("Every pro se plaintiff must notify the clerk of this court in writing of any change of address during the pendency of his case."). The Clerk mailed the 6/20/23 Order Plaintiff at the Knox County Jail, and that mailing has not been returned. Plaintiff's deadline has passed, and Plaintiff has not updated his address. Because the Court cannot contact Plaintiff, and because Plaintiff has failed to follow the Court's orders, the Court dismisses this suit with prejudice. Judgment to enter for Defendants. See Harris v. Emanuele, 826 F. Appx. 567, 569 (7th Cir. 2020) (affirming the district court's denial of a motion to reopen the case after dismissing the plaintiff's suit for failing to comply with the district court's orders to update address and prosecute the case).
