TEXT ORDER entered by Chief Judge Sara Darrow on October 23, 2023. Plaintiff Sonia S. Solis filed a #1 complaint on behalf of herself and Nathan W. Ray. The #1 complaint, however, is only signed by Solis. Federal Rule of Civil Procedure 11(a) requires that every pleading be signed by a party personally if that party is unrepresented. Thus, "Rule 11 requires all unrepresented plaintiffs to sign the complaint." Boriboune v. Berge, 391 F.3d 852, 855 (7th Cir. 2004); see also Abdul-Wadood v. DeBruyn, 89 F.3d 838 (7th Cir. 1996) (table) ("[O]ne [unrepresented] plaintiff cannot sign on behalf of others."). Because Nathan W. Ray did not sign the complaint, he is not a proper plaintiff in this action. The Clerk is DIRECTED to terminate him from the docket. Solis's #2 petition for leave to proceed in forma pauperis ("IFP") is DENIED without prejudice. Solis represents that she receives $1,214.00 in disability income monthly, #2 IFP Pet. 2, and indicates that she supports a daughter and son, id. at 3. But she lists no living expenses for her family for housing, food, medical expenses, etc. Id. at 4-5. The only expense she lists is $1,241.00 in alimony, maintenance, and support paid to others. Id. at 4. As a steward of the public's money, the Court needs accurate information to determine whether to grant IFP status. Solis is given leave to file another petition using the AO239 form, but each portion of the form must be fully and clearly filled out. If Solis's family has no living expenses, she must explain how they survive. The Clerk is directed to send a blank AO239 to Solis. Solis must either file another IFP petition or pay the filing fee by November 27, 2023. (AV) |
