TEXT ORDER entered by Chief Judge Sara Darrow on January 23, 2024. The Court directed Petitioners to properly move to proceed in forma pauperis by filing Form AO239 for each Petitioner by January 4, 2024. Dec. 21, 2023 Text Order. No motions were filed. Petitioner must either file proper motions to proceed in forma pauperis using Form AO239 or pay the filing fee by February 6, 2024. TEXT ORDER entered by Chief Judge Sara Darrow on December 21, 2023. 28 U.S.C. 1915(a)(1) allows a court to authorize commencement and prosecution of a suit without prepayment of fees by a person who submits an affidavit stating his assets and that he is unable to pay such fees. See also Holly v. Wexford Health Servs., Inc., 339 F. App'x 633, 63536 (7th Cir. 2009) ("A district court may allow an indigent plaintiff to file a lawsuit without prepaying the required fees if the plaintiff submits an affidavit with a statement of his assets and attests that he is too poor to pay."). The #2 petition to waive all costs and fees does not include affidavits stating petitioners' assets or that petitioners are unable to pay the costs of the proceeding so it is DENIED. Petitioners may properly move to proceed in forma pauperis or pay the filing fee by January 4, 2024. The Court requires use of Form AO239. Each petitioner must fill out and submit a motion to proceed in forma pauperis. The Clerk is directed to send two copies of Form AO239 to Petitioners. (AV) |
