Filing 6 MERIT REVIEW ORDER entered by Judge Colin Stirling Bruce on 3/4/2024. Pursuant to the Court's Merit Review of Plaintiff's Complaint that is required by 28 U.S.C. Sec 1915A, the Court finds that Plaintiff's Complaint fails to state a claim upon which relief can be granted. In addition, the Court finds that any attempt by Plaintiff to amend his Complaint would be futile. Always Towing and Recovery, Inc. v. City of Milwaukee, 2 F.4th 695, 707 (7th Cir. 2021)(courts may deny leave to amend if an amendment would be futile); McCree v. Grissom, 657 F.3d 623, 624 (7th Cir. 2011) (leave to amend shall be granted where justice so requires, but leave to amend need not be given if an amendment to the complaint would be futile). Accordingly, the Clerk of the Court is directed to enter judgment in Defendants' favor and against Plaintiff. All other pending motions are denied as moot, and this case is terminated. All deadlines and settings on the Court's calendar are vacated. If he wishes to appeal this dismissal, Plaintiff must file a notice of appeal with this Court within thirty (30) days of the entry of judgment. Fed. R. App. P. 4(a). If he wishes to proceed in forma pauperis on appeal, Plaintiff's motion for leave to appeal in forma pauperis must identify the issues that he will present on appeal to assist the Court in determining whether the appeal is taken in good faith. If he chooses to appeal, Plaintiff will be liable for the $605.00 appellate filing fee regardless of the outcome of the appeal. See written order. (KE) |
