TEXT ORDER entered by Judge James E. Shadid on 9/10/2024. Plaintiff files a Motion for Subpoena #7 asking Judge James E. Shadid "to produce the physical documented [sic] 'Delegation of Authority' as proof of jurisdiction, as required by Law." (Doc. #7 at p. 1). Plaintiff's case was dismissed with prejudice on August 20, 2024, based upon his failure to accurately disclose his litigation history. (Doc. #5 ). Judgment was entered the same day. #7 is DENIED. ORDER Entered by Judge James E. Shadid on 8/20/24. IT IS THEREFORE ORDERED:1. This case is DISMISSED WITH PREJUDICE based upon Plaintiff's failure to disclose his litigation history. The Clerk is directed to close this case and enter Judgment. 2. This dismissal shall count as one of Plaintiff's three allotted strikes pursuant to 28 U.S.C. 1915(g). The Clerk of Court is directed to record Plaintiff's strike in the three-strike log.3. Plaintiff's Petition to Proceed in forma pauperis #3 is DENIED. Although Plaintiff's case has been dismissed, he remains responsible for payment of the $405 filing fee.4. If Plaintiff wishes to appeal this dismissal, he may file a notice of appeal in this Court within thirty days of the entry of judgment. Fed. R. App. P. 4(a)(4). A motion for leave to appeal in forma pauperis must set forth the issues Plaintiff plans to present on appeal to assist the Court in determining whether the appeal is taken in good faith. See Fed. R. App. P. 24(a)(1)(C). If Plaintiff chooses to appeal, he will be liable for the $605 appellate filing fee irrespective of the outcome of the appeal. SEE FULL WRITTEN ORDER. (ANW)
