TEXT ORDER entered by Judge Colleen R. Lawless on 12/6/2024. On October 10, 2024, the Court ordered Plaintiff, a detainee at the Rushville Treatment and Detention Facility, to pay the reduced filing fee in the amount of $7.16 within 30 days. (See d/e 10/10/2024). The Court explained that the reduced filing fee could be waived if Plaintiff filed a motion to waive the fee within 14 days and demonstrated good cause for such waiver. Id. To date, Plaintiff has not paid the reduced filing fee or filed a motion to waive the fee. Therefore, this case is DISMISSED WITHOUT PREJUDICE. Plaintiff's Motion for Leave to Proceed in forma pauperis #2 is DENIED. The Clerk is directed to enter judgment and close this case. If Plaintiff wishes to appeal this dismissal, he must file a notice of appeal with this Court within 30 days of the entry of judgment. Fed. R. App. P. 4(a). A motion for leave to appeal in forma pauperis must set forth the issues Plaintiff plans to present on appeal. Fed. R. App. P. 24(a)(1)(C). If Plaintiff chooses to appeal, he will be liable for the $605 appellate filing fee irrespective of the outcome of the appeal. (KE)

TEXT ORDER Entered by Judge Colleen R. Lawless on 10/10/24. This Court has instituted a reduced filing fee procedure for indigent plaintiffs who are institutionalized but who are not prisoners as defined in 28 USC Section 1915(h). A reduced payment will be assessed of 50% of such plaintiff's average monthly income for the six months preceding the filing of the complaint (not to exceed the $405 filing fee). Income includes all deposits from any source. Plaintiff John Loy is currently detained at Rushville Treatment and Detention Facility, and is thus subject to the reduced payment procedure. Plaintiff's ledgers for the past six months show an average monthly income of $14.32. Plaintiff is ordered to send an institutional check or money order in the amount of $7.16, payable to Clerk, U.S. District Court within 30 days from the date of this order. The reduced fee may be waived if the plaintiff, within 14 days of this order, files a motion to waive the fee and demonstrates good cause for such waiver.(ANW)
